How do I know if I can take legal action?

First, check whether the legal deadlines for your case have been missed (165 working days from the date of submission). Then contact us.

Who can take legal action?

Anyone who has a nationality process in Portugal and is facing significant delays in the analysis of their application may be eligible to file a lawsuit. However, it is necessary to prove that there is a risk of damage to a fundamental right. For this reason, we recommend that you request a free assessment so that we can carry out a preliminary analysis of the case to assess the conditions before proceeding with legal action.

What is considered a delayed process?

A case is considered to be delayed when, 165 working days after the application for nationality was submitted (approximately 9 months), the Registry Office has still not made a decision. The deadline of 24 months, announced by the Registry Office on their website, is an admission that they really are breaking the law.

Do I have to go to Portugal to file a lawsuit?

No, the process can be done remotely and the Martins Castro team in Lisbon will take care of everything for you.

Can I take legal action against the state? Couldn't this jeopardize my case?

Recourse to the courts, and to justice in general, is a right guaranteed by the Constitution of the Portuguese Republic, the European Convention on Human Rights and the Charter of Fundamental Rights of the European Union. For this reason, legal action does not hinder the progress of the case, since the law allows the activity of the public administration to be supervised by the courts.

What is the difference between an emergency request and a lawsuit?

The request for urgency is a request made to the Registry Office, in which facts are presented and proven that justify the need for the application for nationality to be processed more quickly. However, the decision on whether or not to accept this request rests exclusively with the registrar. On the other hand, the legal action is brought before a court, where it is necessary to prove that there has been a violation of the fundamental right to Portuguese nationality and the resulting damage to the applicant. The court will impartially analyze and decide the case. The Registry Office can contest the case, but has no power to decide on it.

I don't have a CIL certificate yet, can I still take legal action?
Yes, it is possible to file a lawsuit even without a CIL certificate. According to the Portuguese Nationality Regulation, the application can be analyzed or decided only with the documents proving Sephardic ancestry. The Registry Office cannot reject the application for lack of a CIL certificate. If there are any doubts, the Registry Office should ask for CIL's opinion before making a decision.
